1. Agreement

These Terms of Use ("Terms") are an agreement between you and YAYQ ("YAYQ", "we", "us") and apply to the YAYQ mobile app and the website yayq.com (together, the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

2. Eligibility

You must be at least 18 years old, and old enough to form a binding contract where you live, to use the Service. By using it, you confirm that you meet these requirements. We will close accounts that we believe belong to someone under 18.

3. The Service and AI characters

• YAYQ offers interactive fiction: you play the heroine in romance stories, and fictional characters reply to you. Character replies, suggestions, memories and diary entries are generated by artificial intelligence.
• Characters are not real people. Any resemblance to real persons is coincidental. Characters cannot meet you, call you, or take any action in the real world.
• AI-generated content can be inaccurate, inconsistent or unexpected. It does not reflect our views, and you should not rely on it as fact.
• The Service is for entertainment only. It is not medical, mental health, legal, financial or other professional advice. If you are in crisis or thinking about harming yourself, please contact local emergency services or a crisis line right away. In the US, call or text 988.
• We may add, change or remove characters, stories and features, and we may limit or suspend parts of the Service for maintenance, safety or legal reasons.

4. Your account

• You sign in with Apple, Google or email. Your stories and hearts are saved to your account and available on every device where you sign in.
• You're responsible for activity on your account and for keeping access to your sign-in method secure. Accounts are personal and may not be sold or transferred.
• You can delete your account at any time in the app under Profile → Delete Account. Deleting your account permanently erases your stories and any unused hearts, and does not cancel a store subscription (see section 8).

5. Content rules

Romance is welcome. Keep it respectful and PG-13. When using the Service, you agree not to:

• Request, create or share sexual or sexually explicit content, or try to get around our content filters to do so.
• Create or request any content that sexualizes minors or depicts anyone under 18 in a romantic or sexual way.
• Promote violence, self-harm, terrorism, hate, or harassment of any person or group.
• Use the Service for anything illegal, fraudulent or harmful, or to impersonate real people.
• Share other people's personal information without permission.
• Try to extract our prompts or systems, "jailbreak" the characters, scrape or copy the Service, reverse engineer the app, or interfere with its security or operation.
• Use bots or automated tools to access the Service, or resell or commercially exploit it.

We use automated filters and human review of reports to enforce these rules. We may remove content, limit features, or suspend or close accounts that break them. You can report any message in the app.

6. Your content

• You keep ownership of the messages you write. You give us a worldwide, non-exclusive, royalty-free license to store, process, and display your messages, and to send them to our AI providers, as needed to operate, secure and improve the Service.
• You may use AI-generated story content for your own personal, non-commercial enjoyment. Because AI output is generated automatically, similar content may be produced for other users, and we don't guarantee that it is unique or free of third-party rights.
• You're responsible for what you write. Please don't share sensitive personal information in your stories.

7. Hearts (virtual items)

• Hearts are virtual items used in the Service, for example to receive character replies. The cost of each action is shown in the app.
• You can get hearts as a welcome gift, as a daily gift, with a membership, or by purchasing heart packs. Bonus offers (such as extra hearts on a first purchase) are described in the app and may change.
• Hearts give you a limited, personal, revocable license to use them within the Service. Hearts have no cash value, cannot be exchanged for money or anything outside the Service, and cannot be transferred or sold.
• Hearts are spent when used. Except where required by law, purchases of hearts are final and non-refundable. Refund requests are handled by Apple or Google under their policies.
• We may change heart prices, costs and gift amounts. Unused hearts are lost if your account is deleted or closed for breaking these Terms, and may be lost if we stop offering the Service, in which case we will give reasonable notice where required by law.

8. Memberships (Club and Club+)

• Memberships are optional monthly subscriptions that give the benefits described in the app at the time you subscribe, such as extra daily hearts.
• Payment is charged to your Apple ID or Google Play account when you confirm your purchase.
• Your membership renews automatically each month at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your membership at any time in your App Store or Google Play account settings. Deleting the app or your YAYQ account does not cancel it. When you cancel, you keep your benefits until the end of the period you've paid for.
• Any free trial, if offered, converts to a paid membership unless canceled before the trial ends. Any unused part of a free trial is forfeited when you buy a membership.
• Prices are shown in the app and the store before you buy and may vary by country. Refunds are handled by Apple or Google under their policies.

9. Our intellectual property

The Service, including its characters, stories, artwork, software, and the YAYQ name and logo, belongs to us or our licensors and is protected by law. We give you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for your own non-commercial use, in line with these Terms. If you send us feedback, we may use it without any obligation to you.

10. Ending these Terms

You may stop using the Service and delete your account at any time. We may suspend or close your account if you break these Terms, if required by law, or to protect our users or the Service. Sections that by their nature should survive termination, such as ownership, disclaimers and limitations of liability, will survive.

11. Disclaimers and limitation of liability

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or appropriate.

To the fullest extent permitted by law, YAYQ will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US $50.

Some places don't allow these exclusions or limits, so they may not fully apply to you. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived by contract.

12. Indemnity

To the extent permitted by law, you agree to defend and indemnify YAYQ against claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Service.

13. Additional terms for Apple devices

If you downloaded YAYQ from the Apple App Store:

• These Terms are between you and YAYQ only, not Apple. YAYQ, not Apple, is solely responsible for the app and its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• YAYQ, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection claims, and intellectual property infringement claims.
• You confirm that you are not located in a country subject to a US Government embargo or designated as "terrorist supporting", and that you are not on any US Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms when using the app.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll let you know in the app or by email before they take effect. If you keep using the Service after changes take effect, you accept the updated Terms.

15. General

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Service.
